The MyBarb platform ("MyBarb", "we", "us", "our") is operated by:
These Terms of Service ("Terms") govern access to and use of the MyBarb web application and all related services (collectively, the "Service"). By creating an account, accessing the platform, or clicking "I agree", you ("Subscriber", "User", "you") accept these Terms in full and form a binding contract with us.
If you do not agree to these Terms, you must not use the Service.
If you are accepting on behalf of a business entity, you represent that you have full authority to bind that entity to these Terms.
MyBarb is a business-to-business (B2B) service. It is intended exclusively for use by businesses — barbershops, hair salons, and hair-care professionals operating as business owners or sole traders. It is not a consumer product.
By registering, you confirm that:
Consumer protection laws (including EU consumer rights, right of withdrawal, and mandatory warranty rules) do not apply to this agreement to the maximum extent permitted by law, because this is a commercial B2B agreement between two businesses.

One account corresponds to one physical barbershop location. Multiple locations require separate accounts.
We are not liable for any loss or damage arising from your failure to maintain account security.
MyBarb offers the following access tiers:

Subscription upgrades and billing are currently managed directly by the MyBarb operator on a case-by-case basis. Automated in-app billing and payment processing are not yet active. To upgrade your plan or discuss pricing, contact us directly at ⚠ FILL IN — your@email.com.
When automated billing is introduced, we will provide at least 30 days' prior notice via an in-app notification, and you will be free to cancel before any charges apply.
New accounts may receive trial access to paid-plan features for a limited period at our discretion. No payment is required during any trial period. At the end of a trial, the account reverts to the Free plan unless an upgrade is agreed.
We may change plan pricing at any time. We will give at least 30 days' prior notice via in-app notification. Continued use after the effective date constitutes acceptance of the new pricing.
Each account may receive a unique referral code. When another barbershop registers using your code, both parties may receive subscription credits at our sole discretion. Referral credits:
We reserve the right to disqualify credits and/or terminate accounts found abusing the referral system.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
We reserve the right to suspend or permanently terminate accounts that violate this section, without prior notice and without any obligation to provide a refund or credit.
You retain full ownership of all business data you enter into MyBarb, including shop information, staff profiles, client names, phone numbers, and appointment records. We do not claim ownership over your data.
When you use MyBarb to store personal data about your clients (names, phone numbers), you are acting as the data controller under applicable data protection law (including GDPR where applicable), and MyBarb acts only as a data processor on your behalf.
By using the Service to store client data, you warrant and represent that:
You agree to indemnify, defend, and hold harmless MyBarb from and against any claims, fines, penalties, or costs (including legal fees) arising from your failure to comply with data protection laws in relation to your clients' data.
A Data Processing Agreement (DPA) is available on request for subscribers who require one for GDPR compliance.
Each account may enable an optional public-facing profile page. By enabling it, you:
We reserve the right to disable or remove any public profile that contains false, misleading, defamatory, or unlawful content, without notice and without liability to you.
All software, source code, design, UI elements, logos, trademarks, and original content forming the MyBarb platform are the exclusive property of the operator and are protected by applicable copyright, trademark, and intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-sublicensable, non-transferable, revocable licence to access and use the Service solely for managing your own barbershop.
You may not: copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any part of the Service or its content without our prior written consent.
You retain all intellectual property rights in your own business data (shop name, logo, client list, appointment records). By uploading content (logos, photos), you grant us a limited licence to store and display it solely for the purpose of providing the Service to you.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
MyBarb is a Progressive Web App. Offline functionality depends on your device's local browser storage. We accept no responsibility for data loss caused by:
It is your responsibility to maintain independent backups of critical business data.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Some jurisdictions do not allow the exclusion or limitation of certain damages. If such laws apply to you, some of the above limitations may not apply, but only to the minimum extent required by law.
You agree to indemnify, defend, and hold harmless MyBarb and its operator, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, riot, civil unrest, fire, flood, earthquake, governmental action, power outage, internet infrastructure failure, distributed denial-of-service attacks, or failure of third-party hosting or cloud services.
By you: You may close your account at any time from Settings → "Delete Shop / Close Account". All your data will be permanently deleted from our servers within 30 days. You should export any data you need before closing your account — we cannot recover deleted data.
By us: We may suspend or permanently terminate your account immediately and without prior notice if:
Upon termination for any reason, your licence to use the Service ceases immediately. Sections 7, 9, 11, 12, 15, and 16 survive termination.
We may update these Terms at any time. For material changes, we will provide at least 14 days' prior notice via an in-app notification. For minor or clarificatory changes (corrections, formatting, non-substantive updates), we may update without prior notice.
Continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service before the effective date.

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of ⚠ FILL IN — e.g. "the Republic of Albania" / "the Republic of Kosovo" / "your country", without regard to its conflict-of-law principles.
Before initiating any formal proceedings, both parties agree to attempt good-faith resolution by contacting the other party directly and negotiating for at least 30 days.
If a dispute cannot be resolved by negotiation, it shall be submitted to the exclusive jurisdiction of the courts of ⚠ FILL IN — same country as above.
EU-based subscribers also have the right to use the EU Online Dispute Resolution platform, though we note this is a B2B service and ODR primarily applies to B2C disputes.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyBarb regarding the Service and supersede all prior agreements, representations, and understandings.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.
You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Nothing in these Terms creates any partnership, joint venture, agency, franchise, or employment relationship between you and MyBarb.
